As the fight for equality continues at the federal level, the California Women’s Law Center is proud to co-sponsor, with the Feminist Majority, Senate Concurrent Resolution 92 introduced March 30, 2022, by State Senator Connie Leyva. This important resolution will direct the California Law Revision Commission to identify, and propose legislation to remedy, any California laws that are facially discriminatory on the basis of sex or have such discriminatory effect in their application. To our knowledge, this is the first comprehensive audit of state law in the nation with the objective of proactively identifying and remedying any discrimination on the basis of sex. Moreover, the audit goes beyond a search for facial discrimination in the text of the law itself. Rather, the Commission will be mandated to identify California laws that create a discriminatory effect upon their application. SCR 92 will ensure California complies with the Equal Rights Amendment, which will become effective immediately upon confirmation of its validity by either judicial decision or Congressional action.

At a moment when the principle of gender equality remains contested in national debate, SCR 92 sends a clear message that California will uphold the equal rights of its citizens under the law regardless of sex not merely by word but also by deed. CWLC is proud to co-sponsor this resolution.
